Regulatory and Disciplinary Proceedings

Regulatory and disciplinary proceedings

Professionals are expected to practice to an expected standard at all times. If your conduct is ever brought into question, you may be required to justify your actions. If you find yourself facing regulatory or disciplinary proceedings, it is important to seek expert legal advice as soon as possible, even if you are certain that you will be cleared of any wrongdoing.

In the event of a query arising over your professional conduct, there is usually a process that will have to be followed. This may involve you being required to defend your actions in writing, or you may have to attend meetings or even appear before a disciplinary tribunal. It is possible that the investigation may extend into aspects of your personal life as well as your professional activities, and it is therefore essential to have the appropriate level of legal support, as this really can make a difference to the outcome of these proceedings.

Ackroyd Legal is a leading London law firm, with a dedicated team of business specialists who have the skills and expertise to help you if you are facing disciplinary or regulatory proceedings. Directors’ disqualification proceedings

Directors’ disqualification proceedings may arise when a director or their company is facing an investigation. The Companies Act 1985 empowers the Secretary of State to appoint an investigator, who in turn has the power to access company information from its directors, if there are reasonable grounds to believe that the activities of that company are not in the public interest. If they do not supply the required information or documents, they may be liable for contempt of court.

An investigation may in some cases result in the company directors facing criminal prosecution. The company itself may also be subject to winding up, and relevant information shared with other state bodies such as the Serious Fraud Office. Directors’ disqualification proceedings may also be instigated against company directors.

Because of the potentially serious consequences of such an investigation, it is essential to seek legal advice at the earliest opportunity. The business and corporate law specialists at Ackroyd Legal have many years’ experience in this area, and we offer a broad range of services to companies under investigation, including:
